Thank you for choosing 4x4 Explore for your upcoming off-road adventure.
Before embarking on your tour, it is essential for you to read and understand the following terms and conditions which form your contract with us in accordance with the law of the Australian Capital Territory, Australia.
By making a booking for a tour you are accepting these terms and conditions.
Terms and Conditions
1. Booking and Payment
1.1 A confirmed booking can be made through our website or by contacting our customer service team.
1.2 Payment by bank transfer can be made by contacting our customer service team. A minimum thirty percent (30%) deposit is due at the time of booking and the balance is due not later than six weeks prior to the scheduled start date of your tour. If booking within six weeks of the scheduled start date, payment in full at the time of booking is required.
1.3 If paying through our website using a credit/debit card or Apple Pay, payment in full is required at the time of booking.
1.4 If paying through our website using PayPal, you may choose at the time of booking to pay in full or pay in four instalments using PayPal’s ‘Pay in 4’ option. PayPal’s terms and conditions will apply.
1.5 Prices are quoted in Australian dollars and include all applicable taxes and fees. The quoted price is per vehicle.
2. Cancellations and Refunds
2.1 Cancellation requests must be submitted in writing.
2.2 Cancellations made more than six weeks in advance of the scheduled start date may receive credit towards a future 4x4 Explore tour or a refund less an administrative fee.
2.3 Cancellations within six weeks of the scheduled tour are non-refundable.
2.4 No-shows or participants who arrive late will not be eligible for a refund.
3. Tour Requirements
3.1 All vehicles must be registered with a relevant State or Territory authority and must be mechanically sound and of a make and type suitable for the tour.
3.2 All drivers must hold a valid driver's license and obey all road rules at all times.
3.3 Participants should hold appropriate vehicle, trailer and travel insurances.
3.4 Pregnant women, individuals with pre-existing medical conditions, and individuals with mobility issues should consult with their healthcare provider before booking a tour.
3.5 Participants must always follow the tour guide’s instructions throughout the duration of the tour.
3.6 Participants must prepare their vehicles and equipment for their tour and should consider the equipment and vehicle preparation recommendations provided to them by 4x4 Explore.
3.7 Parents and guardians are responsible for supervising children who undertake the tour with them.
3.8 Other than accredited assistance animals, pets and other animals are not permitted on any 4x4 Explore tours. Owners and carers are responsible for supervising assistance animals on tours.
3.9 4x4 Explore reserves the right to exclude your vehicle or one or more passengers from a tour or tour activity at any time if we do not believe your vehicle will safely complete the tour or tour activity, or you or your passenger/s are unable to complete the tour or tour activities safely. In such cases, you will not be eligible for a refund.
3.10 You are wholly responsible for the recovery and repair of your vehicle/s, trailer/s and other equipment in the event of mechanical fault, breakdown, other failure, or becoming bogged.
4. Exclusions and Indemnity
4.1 While our tour guides prioritise safety, you acknowledge that off-road driving and other activities you undertake on tours involve both obvious and inherent risks to your personal safety. Such risks may include (without limitation):
Hazardous roads or tracks,
Hazardous driving conditions,
Off road driving,
Wildlife,
Water,
Sand,
Rocks,
Mud, and
Vegetation.
In view of such risks, you agree that your participation in a 4x4 Explore tour is at your own risk and you agree that you are responsible for your own safety and personal well-being and the safety and well-being of people travelling with you.
4.2 In consideration of 4x4 Explore accepting your application to participate in a tour you agree to release, indemnify and forever keep indemnified, to hold harmless and to make good 4x4 Explore and its agents, employees and tour guides or any of them to the maximum extent permitted by the law from and against all costs, claims, actions, demands, suits or liability whatsoever with respect to person or property or otherwise, howsoever arising or in any way connected with your participation in the tour and whether or not arising as a result of negligence, breach of contract, trespass, breach of statutory duty or otherwise on the part of 4x4 Explore, its employees, agents or any of them.
4.3 Where 4x4 Explore cannot lawfully exclude liability, its liability to you is limited, at its discretion to:
(i) a further supply of a tour at no charge, or
(ii) a refund of the cost paid for a tour less an administrative fee.
4.4 Notwithstanding any other provision of this contract the limitation of liability and indemnity contained herein shall not apply to any liability arising as a result of, or in connection with:
(i) fraud or willful misconduct by 4x4 Explore; or
(ii) breach of privacy by 4x4 Explore.
4.5 To the fullest extent permitted by law (including the Australian Consumer Law), 4x4 Explore excludes all warranties implied by law except as expressly set out in this contract.
5. Itinerary and Weather Conditions
5.1 The tour itinerary is subject to change without prior notice due to weather, road or park conditions, or road or park closures.
5.2 In the event of itinerary changes, 4x4 Explore will make every reasonable effort to provide a comparable alternative.
5.3 You acknowledge and agree that weather conditions can impact the tour, and refunds will not be provided for changes to the itinerary due to weather.
6. Respect for the Environment and Local Communities
6.1 During the tour you must:
(i) respect and minimise any harm to the natural environment including the land, flora, fauna and cultural sites; and
(ii) comply with all environmental and safety laws applicable to the areas you are traveling in and through and you acknowledge that littering, vandalism or any activity that may harm the environment including waterways, flora, fauna or local communities is prohibited.
7. Gift Cards
7.1 Gift cards remain valid for three years after the date of issue. The date of issue is the date of the gift card email sent by us to you.
7.2 Gift cards may be used to purchase any 4x4 Explore tour or merchandise. Tours must be booked before the gift card expiry date but may occur after the three-year period. Reasonable extensions on the period of use may be provided but any extension must be requested before the gift card expiry date and will be at the sole discretion of 4x4 Explore. Cancellation and refund policies apply.
7.3 Remaining value is stored for future use until the expiry date. Gift cards may not be redeemed for cash.
7.4 The recipient must keep the gift card redemption code secure. Lost or stolen gift cards may be replaced upon evidence of proof of identity and proof of purchase. In such cases, the recipient must advise 4x4 Explore of the loss or theft as soon as possible.
